
A federal appellate court recently declined to stay the orders of a lower court in a case challenging the Trump administration’s authority to deport Venezuelan nationals under a 1798 wartime law. The lawsuit contests the administration’s use of this law to remove individuals from the U.S., and the court’s decision allows the case to proceed without interference from the higher court.
In a 2-1 ruling, a three-judge panel sided with the plaintiffs, halting the Trump administration’s deportation plans. This ruling further delays any deportations under the contested wartime law, strengthening the legal challenge against the policy.
